Terms of Use LOITV TERMS AND CONDITIONS OF USE

1. INTRODUCTION 1.1. (a) www.loitv.ie is a service brought to you by the FAI through Premier Sports (having its registered office at 3A Prince's Street South, Dublin 2, Ireland) in its capacity as service provider to Cumann Peile na hÉireann “Football Association of Ireland” (the “FAI”) whose registered office is National Sports Campus, Abbotstown, Dublin 15, Ireland and which operates LOITV. (b) When we say “we”, “our” or similar, we mean the FAI (also referred to for the purposes of these Terms as LOITV). When we say “you”, we mean any person who accesses or uses that website. 1.2. (a) By registering for, accessing or using content on www.loitv.ie (including all sub-sites and micro-sites controlled by LOITV (or Premier Sports on behalf of the FAI)) (the “Site”), you are entering into a contract with the FAI for the purposes of accessing LOITV on an individual, personal viewing basis and you are acknowledging and agreeing to the disclaimers, terms and conditions (“Terms”) set forth below. For the avoidance of doubt, LOITV is not provided for any commercial premises exploitation (e.g. pubs and bars) unless permission is expressly agreed otherwise. If you do not agree to these Terms, you should not use the Site. 2. THE LOITV SERVICE 2.1. The LOITV service comprises the provision of online access to various types of content relating to the FAI League of Ireland competitions and such other various types of content relating to the FAI as the FAI may decide in its discretion to make available on the Service. This content includes the streaming of matches (including but not limited to Premium Content) and the provision of news, audio, updates, fixtures and other information of interest to FAI or League of Ireland fans (“Content”). While some Content is available in all countries without the requirement to pay a fee, the availability of certain Premium Content, such as (without limitation) a live or deferred match broadcast and any other content under a subscription/pass per pay-per-view product (“Premium Content”), may be restricted to certain geographical regions. Collectively, the provision of Content and associated services are referred to in these Terms as the “LOITV Service”. Any and all content that is included in the LOITV Service may be removed at any time without notification or justification and solely at the discretion of FAI or its authorised representatives. Whilst we endeavour to maintain strong quality standards for the Content, the FAI or its authorised representatives cannot be held liable or responsible for the video or audio quality of the Content. 2.2. These Terms do not authorise you to receive any other pay-per-view or other services of any kind from LOITV or the FAI, except for day pass or access pass content which will be available for a set period of time. The time period for these passes will start at the time of the first stream, not when the pass was purchased. 3. AVAILABILITY OF GAME CONTENT 3.1. Any specific geographical or cost conditions associated with particular Premium Content are specified on the LOITV access points, for example, the Site. If you choose to subscribe for Premium Content, you are responsible for paying the charges associated with the Premium Content. Access to LOITV may be based on the location of the viewer. Therefore, if you are not located in the appropriate country to receive the particular LOITV Service, the LOITV Service will not be available to you, even if you have paid for it. This includes but is not limited to the use of VPNs and other devices which mask the end user's IP address. 3.2. If you choose to purchase any Premium Content, you are representing and warranting to LOITV that: (a) you are over 18 years of age; (b) you agree to pay the specified charges for the relevant LOITV Service; (c) you have read and understood the geographical or other restrictions associated with the particular LOITV Service(s); and (d) you and any person who accesses or uses the LOITV Service(s) will comply with these Terms. 3.3. DEFERRED/ON DEMAND CONTENT LOITV recognises that kick-off times for matches in Ireland are not always practical for viewers abroad. Accordingly, content may remain available to view on the platform on a delayed basis until one month from the time of purchase and can be watched as many times as you like until the content is removed (at the FAI’s absolute discretion). Day pass or access pass content will be available for a set period of time starting from the time of the first stream, not the time of purchase. However, you may not download or attempt to save Content for viewing otherwise than on the Site. 3.4. SITE AVAILABILITY LOITV shall use commercially reasonable endeavours to make the Site available continuously. However, we do not warrant that the Site or any Content will be available on a 24-hour basis as it may be necessary to temporarily or permanently remove Content for technical maintenance or other operational reasons. If we remove Premium Content permanently without providing you with reasonable notice or having not provided a reasonable opportunity to view it, you may apply for a refund of the charges associated with that Content. Any refund will be at the sole discretion of the FAI or its authorised representatives, acting in a reasonable manner.

If your stream isn't working due to broadband issues, device issues or you are encountering streaming issues, please contact us through our customer support service immediately, and we will review your case. If we are notified during the event, we can make attempts to investigate and rectify the problem; issues reported after the event will not qualify for a refund. All refunds are entirely at the discretion of LOITV in terms of eligibility and the amount due. 4. YOUR ACCOUNT INFORMATION 4.1. When you wish to purchase Premium Content on the Site, you will be asked to enter an email address, password, and credit/debit card information. To view Premium Content that has already been purchased or to view other accessible content, you will only be asked to enter an email address and password to access your account and content. We store and process your personal data in accordance with our Privacy Policy which can be found HERE. 4.2. Once your payment is processed by a third-party payment provider, you will receive email payment confirmation of your purchase and access instructions that will allow you to access the online stream of the relevant Premium Content. 5. COMPATIBLE DEVICES 5.1. SITE (a) LOITV works on most modern internet devices. To view Content, you will need: a broadband internet connection of an acceptable bandwidth for video viewing; a computer, tablet, or mobile device (such as an iPhone or Android smartphone); and a compatible web browser. (b) Once you purchase Premium Content on the Site, you will be able to access the Premium Content stream on any number of compatible devices, but only one device will work at any one time.

(c) The LOITV Service works on the Site through your web browser.

(d) Viewing Content on the Site will count towards any mobile data allowance or broadband usage limits that apply to your mobile or broadband service. 6. PAYMENT, FEES, AND TRIAL OFFERS 6.1. Billing To be able to watch content on LOITV, you must provide us with a valid payment method. Unless you cancel your subscription before the next billing date, you agree that we will charge the Subscription Fee for the next Subscription Period or Fixed-Term Subscription to your selected payment method, provided that such cancellation is made at least 30 days prior to the next billing date. If payment of the Subscription Fee fails for any reason, we may continue trying to charge your payment method and suspend or terminate your access to LOITV until we have been able to collect the Subscription Fee.

Your selected payment method is stored by Premier Sports or a third-party provider in accordance with the International Security Standards (PCI DSS Payment Card Industry Data Security Standard). You can update your payment method by going to the "My Account" page on the Site. Following any update, you authorise Premier Sports to continue to charge according to your most recently selected payment method.

LOITV will not be made available via any third party. Attempting to access LOITV through unauthorised third-parties, is considered a breach of these Terms, and LOITV reserves the right to immediately terminate your access without a refund.

We reserve the right to refuse payments at our reasonable discretion including but not limited to, if we suspect fraudulent and/or illegal activity linked to the payment method provided to us.

6.2. Fees and Changes to Your Subscription Plan Fees are due in accordance with our current price list, which is available on the Site. Content purchased as One-Time Payments is not included in your subscription and is subject to additional fees. Prices displayed on the Site exclude any data communication costs or fees which your Internet or telecommunication service provider may charge under your contract with such service provider, or transaction or other fees charged by your bank or credit card provider in connection with payment of the Subscription Fee.

We may change the Subscription Fees and other fees for LOITV from time to time ("Fee Change"). We will notify you by email and/or via your user account on LOITV with at least thirty (30) days' notice before the Fee Change takes effect. If you do not accept the Fee Change, you have the right to cancel your subscription without penalty with effect from the date the Fee Change enters into force, provided that we receive notification no later than the day before the Fee Change enters into force. If you are on a Fixed-Term Subscription and cancel your subscription in accordance with this paragraph, we will refund your Subscription Fee on a pro rata basis. A Fee Change may also include the introduction of new fees, such as invoicing fees. If you choose to upgrade your subscription to a package with a higher Subscription Fee, you will be charged the new Subscription Fee immediately upon such upgrade. 6.3. Trial Offers We may offer new customers different types of trial subscriptions, for example free of charge or at a reduced price for a specific period of time ("Trial Offer"). To be eligible to use a Trial Offer, neither you nor any other member of your household must have previously used a Trial Offer or any similar marketing offer from us. If you or any other member of your household have already taken advantage of a Trial Offer, you will be charged the Subscription Fee as if you were signing up for a standard monthly subscription at the current price. We reserve the right to check whether you meet the requirements based on the information you have submitted when signing up for a Trial Offer.

Upon expiry of a Trial Offer, the Trial Offer will automatically be converted into a monthly subscription plan, unless you terminate the subscription prior to the last day of the Trial Offer period. Terminations are done via "My Account" on the Site. Separate terms may apply for promotions (including trial offers) offered by third parties. If you register for any such promotions, please note that cancellation of such trial offers must be done in accordance with the instructions provided by the third party. The prices provided by such third party will apply to your LOITV subscription following the expiry of the trial offer. 7. TERM AND TERMINATION 7.1. These Terms govern all use of Content at any time. However, the license to use “pay” Content is limited to the time on which that Content is made available for viewing (see paragraph 3.3 and 3.4 above). 7.2. Your access to the LOITV Service or any Content thereon may be terminated by us if you act in breach of these Terms or if we have reasonable grounds for suspecting a breach. We will not refund any payments made under these Terms if we terminate access in such circumstances. Breaches include, but are not limited to, unauthorized sharing of login credentials, accessing LOITV from restricted regions using VPNs, or engaging in activities that violate these Terms. 7.3. Our Termination We reserve the right to terminate your subscription or otherwise suspend your access to LOITV at any time. If we terminate your subscription, we will offer you the following: • continued access to LOITV for the remainder of the current Subscription Period, or for Fixed-Term Subscriptions the remainder of such fixed term, or a full or partial refund of the most recently paid Subscription Fee (proportionate to our termination or suspension), without renewal of your subscription; and/or • access to individual content that you have already purchased through a One-Time Payment to the extent we have the right to grant such license. We have the right to suspend or terminate your access to LOITV with immediate effect and demand payment for any outstanding Subscription Fee(s) if you are in breach of these Terms. If you have a Fixed-Term Subscription, we may require you to immediately pay the Subscription Fee for the remainder of the term. 8. YOUR RIGHT OF TERMINATION 8.1. You may terminate your subscription at any time via the "My Account" page on the Website: https://www.subscribe.loitv.ie/login

Your “Termination” will take effect:

At the end of the Subscription Period during which you notify us that you wish to terminate your subscription (if you have a Fixed-Term Subscription, the termination will take effect at the end of the predetermined Subscription Period); or At the end of the notice period described in the sections "Changes in LOITV and to these terms" or "Fees and changes to your subscription plan" in these Terms, provided that you provide us with at least thirty (30) days' notice of termination. Subject to the “Right of Withdrawal” section above and your rights under applicable consumer protections laws for non-conformity, please note that your termination of a subscription does not affect your obligation to pay for the remainder of the current Subscription Period, nor does it entitle you to a refund of any Subscription Fee paid in advance for the remainder of the Subscription Period.If you terminate your subscription, you will have continued access to the content you have purchased through One-Time Payment. However, we reserve the right to terminate or restrict access to the content in accordance with these Terms. Please note that your user account will remain active even if you terminate your subscription and that applicable parts of these Terms, as amended from time to time, will remain in force as long as you keep your user account with us. You may delete your user account by contacting our Customer Service (see "Contact Information" below).9. INTELLECTUAL PROPERTY LICENCE 9.1. All Content and other materials incorporated in or accessible through the Site, including, without limitation, text, photographs, images, graphics, illustrations, logos, button icons, audio clips, video clips, software, and other content, and the compilation, collection, arrangement, and assembly thereof (including the look and feel of the Site), are protected by Irish and international copyright laws, and are owned, controlled or licensed by the FAI, or by the original creators of such materials or their permitted licensors. Such materials may be used only for viewing the Site in the ordinary course and subject to the restrictions and conditions set out in these Terms. Any other use of such materials, including any copying, reproduction, modification, sale, distribution, extraction, re-utilisation, transmission, republication, downloading, display, posting, performance, or other exploitation thereof by any means or medium without the prior written permission of the copyright owner is strictly prohibited. 9.2. If you purchase Premium Content, LOITV grants you a non-exclusive, non-transferable right to view the Premium Content in question during the published availability windows for that Premium Content and subject to the restrictions and conditions set out in these Terms. The foregoing licence is subject to your payment of all applicable charges, is solely for non-commercial use and expires once the Premium Content is removed from the Site by LOITV. 9.3. You are prohibited from using LOITV Content to create derivative works, compilations, or any other unauthorized materials.

10. CHARGES AND APPLICABLE TAX 10.1. When you purchase from LOITV: Charges quoted on the Site are in Euro. If you choose to pay using a currency other than Euro, you bear any exchange rate risk and will be charged an additional currency conversion processing fee. LOITV is not responsible for any transaction or conversion fees imposed by your bank or card issuer. 10.2. To make a purchase of Premium Content from LOITV, you are required to provide payment card (“Payment Card”) details, and by completing the purchase you are warranting and representing to LOITV that:

(a) You are the authorised payment card holder; (b) Your payment card details are valid, up to date and complete; (c) You are complying with the rules governing your payment card purchases; and you are irrevocably authorising LOITV, through its contracted third-party payment process agents, to deduct the charges against the relevant card. 10.3. Premium Content is non-refundable and all Content is non-transferable. If you do not view Premium Content you have purchased either live or within the availability window for the event, you will still be charged (subject to clause 7.1 above). However, refunds for individual games purchased after the “live” commencement are granted only after reviewing the case in question and are at our discretion. 10.4. The prices quoted on the LOITV website are subject to change. While we will not increase the cost of a package you have already purchased, we reserve the right to change our pricing at any time. You will have a choice at that point whether or not you wish to pay the revised charges. 10.5. LOITV reserves the right to refuse any purchase request for Premium Content for any reason. Orders may be delayed or cancelled if LOITV is not given completely accurate information and/or is unable to contact the person who has placed the order and/or the primary cardholder for the order. 11. UNAUTHORISED USE 11.1. You may not use the LOITV Service or any part of it other than to view the Content on the Site for private and non-commercial purposes. LOITV reserves the right to monitor access patterns, device usage, and login activity to detect and prevent unauthorized use of the Service. 11.2. You shall not except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties and except to the extent expressly permitted under these Terms:

(a) attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any portion of the Content in any form or media or by any means; or (b) attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form all or any of the software underlying the LOITV Service; or (c) access all or any part of the Content in order to build a product or service which competes with the LOITV Service; or (d) use the Site or the LOITV Service to provide services to third parties; or (e) license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the Content available to any third party, or (f) attempt to obtain, or assist third parties in obtaining, access to Content other than as provided under this these Terms; and you shall use all reasonable endeavours to prevent any unauthorised access to, or use of, the Content and, in the event of any such unauthorised access or use, promptly notify LOITV. 11.3. You agree not to use the Site or cause or permit the Site to be used:

(a) so as to jeopardise or prejudice the operation, quality or integrity of the Site, or the operation, quality or integrity of any telecommunications network; (b) for any commercial purpose including any direct marketing, surveys, contests or pyramid schemes, nor to use the Site to participate in or cause others to participate in sending chain letters, junk email, spam, duplicative or unsolicited messages, advertising or promotional material; (c) to harvest or otherwise collect information about others, including email addresses, without their consent; (d) to distribute, download, upload or transmit any material which contains viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs; (e) contrary to the terms and conditions of any Internet Service Provider whose services you may use. 12. LIABILITY 12.1. The Site is provided by LOITV on an “as is” basis. To the fullest extent permitted by applicable law, LOITV disclaims all warranties, express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, compatibility, security, accuracy or infringement. 12.2. Neither LOITV, the FAI, nor any of their affiliates, nor any of our or their respective licensors, licensees, service providers or suppliers warrant that the Site or any function contained in the site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the servers that make the Site available are free of viruses or other harmful components. 12.3. Although the Site is accessible worldwide, not all content is available to all persons or in all geographic locations. LOITV reserves the right to limit, in its sole discretion, the provision and quantity of any Content to any person or geographic area it so desires. Any offer for any product or service made in or through the Site is void where prohibited. LOITV shall not be responsible for any failure of your communications networks and facilities, including the internet, and you acknowledge that the LOITV Service may be subject to limitations, delays and other problems inherent in the use of such communications facilities. 12.4. You expressly understand and agree that (to the fullest extent permitted by law) the FAI or any of its affiliates, and any of our or their respective licensors, licensees, service providers or suppliers, shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), arising out of, or resulting from the use or the inability to use the Site. 12.5. In no event shall the total liability of the FAI to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence)) exceed the amount paid by you to us, if any, for accessing the Site or purchasing Premium Content. If you are dissatisfied with any portion of the Site, or with any of these Terms, your sole and exclusive remedy is the discontinuation of your use of the Site. 12.6. Nothing in these Terms excludes the liability of LOITV for: (a) death or personal injury caused by LOITV’s negligence; or (b) for fraud or fraudulent misrepresentation. 12.7. The above exclusions and disclaimers apply to the fullest extent permitted by law. 13. LINKS TO THIRD PARTY SITES 13.1. The Site contains links to third-party websites. These links are provided solely as a convenience to you and not as an endorsement by LOITV of the content on such third-party websites. The FAI is not responsible for the content of linked third-party sites, and we do not make any representations regarding the content or accuracy of materials on such third-party websites. If you decide to access linked third-party websites, you do so at your own risk and in accordance with the prevailing terms and conditions of such third-party sites. 13.2. LOITV generally welcomes the hyper-linking to the Site from other appropriate websites provided such links are to the Site’s homepage (and no deeper within the Site). Any links to the Site from another website must be presented in such a manner that the viewing of the Site is not impaired by framing or similar techniques that may impair the visitor’s user experience.

14. Waiving of Cooling-Off Period for Digital Content Under EU law, consumers have the right to a 14-day cooling-off period for most online purchases. However, this right does not apply to certain types of digital content once its download or streaming has commenced. By purchasing digital content from LOITV, you acknowledge and agree to the following: 14.1. Immediate Access to Digital Content Upon purchase, you will be provided with immediate access to the digital content you have selected, either through download or streaming. 14.2. Waiving of Cooling-Off Rights By clicking "Accept and Purchase" at checkout, you expressly consent to the immediate performance of the contract and waive your statutory right to cancel within the cooling-off period. This waiver is necessary for us to provide you with instant access to your purchased content, as permitted under Article 16(m) of Directive 2011/83/EU on Consumer Rights. 14.3. Acknowledgment of Waiver You acknowledge that once the download or streaming of the digital content has begun, you lose your right to withdraw from the contract. 14.4. Exceptions to Waiver If technical issues prevent access to the digital content, you may be eligible for a refund or alternative resolution, as determined on a case-by-case basis in accordance with EU consumer protection laws. 14.5. 15. GENERAL 15.1. LOITV reserves the right to transfer our rights or obligations under these Terms to any company, firm or person provided this does not affect your rights under these Terms in a negative way. 15.2. These Terms are personal to you. You may not transfer your rights or obligations under these Terms to anyone else, and no third party is entitled to benefit under these Terms except in the circumstances specified in paragraph 4.3. 15.3. Where we are required or permitted under these Terms to give you notice in writing, we will post the relevant information on the Site. We may also send notices using any of the contact details we hold for this purpose (including, unless you tell us otherwise, to the primary email address we hold for you). 15.4. LOITV shall have no liability to you under these Terms if we are prevented from or delayed in performing our obligations under these Terms, or from providing the LOITV Services or any of the Content by acts, events, omissions or accidents beyond our reasonable control, including, without limitation, strikes, lock-outs or other industrial disputes, failure of a utility service or transport or telecommunications network, act of God, pandemic (including Covid-19), war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or sub-contractors. 15.5. No failure or delay by a party to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy. 15.6. Any material changes to these Terms will be notified to you by email or at the time you make your next purchase of Premium Content. 15.7. These Terms (including the Privacy Policy) constitute the entire agreement between LOITV and you with respect to your access to and use of the Site, the LOITV Services and the Content. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions. 15.8. The FAI reserves the right to amend these Terms and Conditions at any time. 15.9. The Site has been created by Premier Sports on behalf of the FAI and is managed by Premier Sports. These Terms will be governed by, and construed and enforced in accordance with, the laws of Ireland. You hereby unconditionally and irrevocably submit to the exclusive jurisdiction of the Irish courts. 15.10. All complaints can be sent to support@loitv.ie and will be responded to within 72hrs of receips

  Glossary 1. "Fixed-Term Subscription"  • A subscription plan with a predetermined duration (e.g., one month, three months, or a year) that cannot be canceled mid-term without penalty. 2. "Premium Content"  • Content that requires payment to access, such as live or deferred match broadcasts, or other subscription-based or pay-per-view content offered on LOITV. 3. "Day Pass" / "Access Pass"  • A short-term access option granting users a fixed period (e.g., 24 hours) to view specific LOITV content, with time beginning upon the first stream rather than purchase. 4. "Subscription Fee"  • The recurring payment amount charged to access subscription-based LOITV services, as specified on the Site. 5. "Trial Offer"  • A promotional subscription period offered to new users, free or discounted, for a limited time before converting to a standard paid subscription. 6. "One-Time Payment"  • A non-recurring payment made to access specific content or features without requiring a subscription. 7. "Fee Change" o Adjustments made to the pricing of subscription plans or additional services, with advance notice provided to users. 8. "Cooling-Off Period"  • A statutory right under EU consumer law allowing consumers to cancel purchases within 14 days, waived for digital content upon commencement of download or streaming. 9. "Unauthorized Use" o Any action that violates these Terms, such as sharing login credentials, using VPNs to access restricted content, or attempting to reverse-engineer the Site. 10. "Third-Party Billing" • Any billing or payment processing conducted through an external platform or provider not authorized by LOITV, which is prohibited. 11. "Geographical Restrictions" • Limitations on accessing certain content or services based on the user’s physical location, typically determined by IP address. 12. "Device Limitations" • The restriction that allows only one device to stream LOITV content at a time per account, regardless of the number of devices registered. 13. "Subscription Period" • The recurring cycle for which a subscription is valid (e.g., monthly, annually), during which users are billed and can access services. 14. "Content Availability Window" • The period during which purchased Premium Content is accessible for streaming, after which it is removed from the Site. 15. "Refund Policy" • LOITV’s policy regarding eligibility and process for refunds, particularly for technical issues or permanently removed content. 16. "International Security Standards (PCI DSS)" • The industry-standard framework for securing payment card transactions, ensuring user payment information is stored and processed securely.
